These terms and conditions will apply when you access our website being www.todotoday.co.za ("Website"). We ask that you read these terms and conditions carefully.

1. Acceptance of Terms

By accessing and using this Website, you agree to accept, without modification, limitation or qualification, the terms and conditions contained herein (the "Terms and Conditions").

2.4 B4i Holdings is the owner and intellectual property rights holder of this Website as well as the underlying domain.
2.5 You represent and warrant that you possess the legal right and ability to access this Website and to be bound to these Terms and Conditions and to use this Website in accordance with all terms and conditions herein.
2.6 You promise to us that you are old enough to enter legally binding contracts through this Website and you know you will be responsible for all transactions concluded by you when using your login information.

3. Overview of terms and conditions, associated documents and amendment rights

3.1 These Terms and Conditions shall override any contrary terms or conditions published by us or appearing on this Website in relation to any order placed by you with us.
3.2 The terms of our Privacy Policy shall be deemed to be incorporated into these Terms and Conditions and shall form an integral part of these Terms and Conditions. We reserve the right to amend our Privacy Policy from time to time with or without notification to you.
3.3 We further reserve the right to amend these Terms and Conditions. Should we choose to do so, we will post our updated terms and conditions on this Website.
3.4 Any amendments to our Privacy Policy and to these Terms and Conditions will not have any retrospective effect.
3.5 In addition to these Terms and Conditions and our Privacy Policy we have also made available our Manual in accordance with Section 51 of the Promotion of Access to Information Act 2 of 2000. For a copy of the Manual, please click here

4. FlySafair Platform B-BBEE Contributions

4.1 All contributions made are non-refundable.
4.2 Flight credits purchased are promotional products which cannot be exchanged or refunded for the cash equivalent.
4.3 Flight credits purchased in terms of clause 4.2 will be sent to you directly by Flysafair, after confirmation of payment has been received and may be allocated at the sole discretion of the business.
4.4 Flight credits must be utilised within 2 (two) years from date of allocation to the business.
4.5 Contributions will be fully tax deductible whereas free flight credits could attract a tax liability, this will however still result in a positive tax positions for the business.
4.6 Credits do not cover taxes and duties payable when making a booking.
4.7 Gross amounts paid are for (1) Enterprise Development; (2) the purchase of flight credits; and (3) Supplier Development.
4.8 The payment as per 4.7 may result in a bonus point for enhancement of the beneficiary from an Enterprise Development Beneficiary to a Supplier Development Beneficiary.
4.9 All contributions made by companies (except those in the Information and Communication Technology Sector Code “ICT” and Construction Sector Codes) to B Rewarded can only contribute towards Enterprise Development once, any additional payments made will only count towards Supplier Development.
4.10 Companies who are measured in accordance with the ICT codes will contribute their Enterprise Development contributions to B4i Intermediate Products, an ICT Company and Supplier Development to B Rewarded and multiple contributions can be made to either.
4.11 Once payment has been received, the following supporting evidence for verification purposes will be provided:
4.11.1 Enterprise and Supplier Development Agreement (or Annex thereto for additional Supplier Development contributions as per 4.9)
4.11.2 B-BBEE Affidavit for the applicable Beneficiary
4.11.3 Confirmation Letter by the applicable Beneficiary
4.11.4 Invoices for all contributions and purchases made
4.11.5 SANAS Verification Agency confirmation of Qualifying Beneficiaries
4.12 The company making the contribution will be required to keep a copy of the proof of payment(s) for verification purposes.
4.13 The Enterprise and Supplier Development Agreements’ is an integral part of the Terms and Conditions, with corresponding terms reflected therein as in clause 4. Acceptance of the Terms and Conditions is an automatic acceptance of the Enterprise and Supplier Development Agreement.
4.14 The calculator provided by this website has been simplified for ease of use and should you not be sure of the sector code applicable to your company you should seek appropriate advice.
4.15 We do not guarantee that all verification agencies will apply the same methodology used by this website and do not guarantee that the full score will be awarded by such verification agencies.

5. Care SA Platform B-BBEE Contributions

5.1 All contributions made are non-refundable.
5.2 Funds are administered by the Business for Empowerment Foundation with PBO number 930069201.
5.3 Funds donated will solely go towards a feeding scheme for families and communities affected by the COVID 19 pandemic.
5.4 Contributions made in personal capacity will receive a confirmation letter from the Business 4 Empowerment Foundation.
5.5 Contributions made by businesses will receive a confirmation letter from the Business 4 Empowerment Foundation accompanied by an independent confirmation for Socio-Economic Development purposes.
5.6 Should a Section 18A certificate be required, the confirmation letter must be sent to info@b4ef.org.za requesting same.

6. B4i Validations and Tutorial Platform

6.1 B4i will confirm the validity of B-BBEE Certificates to ensure that same was issued by a SANAS Accredited verification agency and that the certificates are not fraudulent.
6.2 Affidavits will be checked to confirm that it was completed by an authorised person in the correct format and sector code.
6.3 Validated certificates will be presented to corporate buyers to promote the companies which submitted their certificates for validation.
6.4 We do not guarantee that certificates issued are issued in accordance with the applicable thresholds used to determine the scorecard to be applied.
6.5 Tutorials are not sector specific and are a generic discussion on the principles and scorecards of the different elements.

7. Payment

7.1 In the event that a quote is requested, an email will be sent directly to the email address provided.
7.2 Payments are facilitated by PayFast, a company independent from us.
7.3 Visa, Master Cards and Electronic Fund Transfers are accepted.
7.4 Card transactions will be acquired for you or your company via PayFast (Pty) Ltd who is the approved payment gateway. PayFast uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no card details are stored on the website. Users may go to www.payfast.co.za to view their security certificate and security policy.

8. Website availability

While we use all reasonable endeavours to make the Website and associated services available, we cannot guarantee that they will operate continuously or without interruption.

9. Condition of access and use of Website

9.1 You acknowledge that this Website is owned by B4i Holdings.
9.2 Your access to and use of this Website is solely at your own risk.
9.3 We make no representation, warranty or covenant whatsoever about the reliability, stability or virus free nature of our Website or other materials displayed herein. To the maximum extent permitted by applicable law, we disclaim all representations, warranties and covenants relating to the data, information, software, products and services contained in this Website. All such data, information, software, products and services are provided "as is" without representation, warranty or covenant of any kind, including all implied warranties and conditions of merchantability, fitness for a particular purpose, title and non-infringement.
9.4 In no event will we be liable for any direct, special, indirect, incidental, consequential (including loss of revenue or profits, among other things), punitive, or exemplary, damages of any kind or subject to equitable or injunctive remedies (whether based on breach of contract, tort, negligence, strict liability or otherwise) arising out:
9.4.1 Any transaction concluded between us pursuant to these Terms and Conditions;
9.4.2 Access to, or use of this Website, or delay or inability to access or use this Website, or any information contained in this Website;
9.4.3 Errors in any pricing and/or information contained on this Website; or
9.4.4 The availability and utility of the transaction and payment mechanism and/or any information contained therein.
9.5 Nothing in the aforementioned limitation of liability shall exclude liabilities not permitted to be excluded by applicable law.
9.6 You agree not to post or transfer to our Website (nor include in any message) any material which is obscene, misleading, inaccurate, defamatory, illegal, in breach of any copyright or other intellectual property right, or damaging to data, software or the performance of our or any other parties’ computer system. You agree to indemnify us in respect of any liabilities, losses, expenses, or other costs whatsoever incurred as a result of a breach of your obligation under this 9.1 including, but not limited to, any claims made against us by any third party.
9.7 In consideration of agreeing to your use of this Website, you acknowledge that the ownership in any intellectual property rights (including, for the avoidance of doubt, copyright) this Website belongs to us. Accordingly, any part of this Website (or its source HTML code) may not be used, transferred, copied or reproduced in whole or in part in any manner other than for the purposes of utilising this website, meaning that you may only display it on your computer screen and print it out on your printer for the sole purpose of viewing its content.

11. Choice of law and jurisdiction

Your use of the Website and the terms and conditions is subject to the laws of the Republic of South Africa and you agree to submit to the non-exclusive jurisdiction of the South African High Court, North Gauteng Division. We reserve the right to bring proceedings to the courts of the country of your location.

FAQs

Flight Credits

  • Can individuals also qualify for free flight credits?
    Flights credits are only awarded to businesses who can allocate these flight credits to personnel or customers as part of promotional or rewards campaigns.
  • Which businesses qualify for free flight credits?
    Business that make BEE Enterprise and/or Supplier Development contributions and direct such contributions towards ToDo Today approved beneficiaries, meeting the requirements as stipulated in the BEE Codes of Good Practice or Sector Codes.
  • How many flight credits will be allocated to the business?
    A business that pays a gross amount online to a ToDo Today approved beneficiary will qualify to procure a certain, but limited amount of promotional flight credits at a discounted rate of approximately 99%. The higher the amount paid, the more promotional flight credits will be offered at the discounted rate.
  • Do I need to make an extra payment for the promotional flight credits?
    No, this minimal amount is taken from the amount already paid online to the ToDo Today approved beneficiary and an invoice will be supplied automatically.
  • What about the balance of the amount paid?
    The balance is structured as a BEE Enterprise and/or Supplier Development contribution to be submitted by the business to the verification agency as an Enterprise and/or Supplier claim towards the BEE Scorecard.
  • Please explain using an example of such a transaction
    Your business pays R10 000 on www.todotoday.co.za towards an approved beneficiary. Flight credits worth R4 500 is awarded to your business for R45. Thus R10 000 minus R45 = R9 955. R9 955 is structured as BEE Enterprise and/or Supplier Development.

ToDo Today Beneficiaries and BEE Claim

  • How do I know that the ToDo Today beneficiaries are meeting the requirements for the claim to be valid?
    A SANAS accredited verification agency has already assessed the beneficiaries and issued a statement confirming that they meet the requirements as stipulated in the Codes of Good Practice and, or Sector Codes.
  • How will I explain this to the verification agency?
    Once payment has been made all the evidencing requirements will automatically be forwarded via email. Simply print and present the documents to the verification agency.
  • Will the full Enterprise and/or Supplier Development Contribution qualify as a claim?
    The claim will be dependent on your net profit after tax and turnover applicable at verification. The online calculator will guide you towards an estimated target, but it will never be fully accurate as all figures you supply is based on forecasted turnover and net profit after tax numbers for the end of the current financial year.

Using Flight Credits

  • How will the flight credits be allocated to the business?
    Once payment is confirmed in the account you will receive a confirmation from the ToDo Today platform and within five working days you will receive direct confirmation from FlySafair.
  • How do I make flight bookings?
    Flight bookings are made directly with FlySafair. FlySafair will communicate all related matters directly with the person nominated by the business.
  • May I direct enquiries on flight credits to ToDo Today?
    ToDo Today will have no information on this other that the payment was made and forwarded to FlySafair together with the business and contact details.
  • May I direct enquiries on the BEE Enterprise and/or Supplier Development Contributions to ToDo Today?
    Yes, ToDo Today will direct these enquiries to the relevant persons and organisations.
